Estate Planning

Protecting Your Family, Your Assets, and Your Legacy

Estate planning is about more than distributing assets, it is about providing clarity, security, and peace of mind for the people who matter most.  A well-designed estate plan ensures that your wishes are honored, your loved ones are protected, and unnecessary legal complications are avoided.

The Law Offices of Robert C. Brady, P.C. provides estate planning services to individuals and families throughout New Jersey, helping clients create practical plans tailored to their personal, financial, and family circumstances.  Whether you are preparing your first estate plan or updating existing documents, thoughtful planning today can prevent uncertainty tomorrow.

Why Estate Planning Matters

Many people assume estate planning is only necessary for the wealthy or elderly.  In reality, every adult benefits from having essential legal documents in place. A comprehensive estate plan can:

· Direct how assets are distributed

· Protect minor children and dependents

· Avoid unnecessary probate complications

· Provide financial and healthcare decision authority if incapacity occurs

· Reduce conflict among family members

· Preserve family assets and business interests

Without proper planning, New Jersey law, not your personal wishes, determines many important decisions.

Estate Planning Services

We work with clients to prepare customized estate plans that may include:

Last Will and Testament

A will ensures your assets are distributed according to your wishes and allows you to designate guardians for minor children.

Durable Power of Attorney

This document authorizes a trusted individual to manage financial and legal matters if you become unable to do so.

Advance Directive for Healthcare (Living Will)

An advance directive allows you to express healthcare preferences and appoint someone to make medical decisions on your behalf.

Trust Planning

In appropriate circumstances, trusts may be used to manage assets, provide privacy, or simplify the transfer of property.

Estate Plan Reviews and Updates

Life changes—marriage, children, business growth, or retirement—often require updates to existing plans.

Estate Planning for Business Owners

Business owners face additional planning considerations.  Estate planning can help ensure continuity and stability by addressing:

· Business succession planning

· Ownership transfers

· Buy-sell coordination

· Protection of business assets

· Transition planning for family-owned companies

Mr. Brady’s business law and commercial litigation experience provides valuable insight when integrating estate planning with business interests.

A Practical and Personalized Approach

Estate planning should not feel overwhelming.  Our process focuses on clear communication and practical solutions tailored to each client’s goals.  We take time to understand:

Frequently Asked Questions

Please reach us at rbrady@bobbradylaw.com if you cannot find an answer to your question.

Yes.  Estate planning is not only about wealth, it ensures that trusted individuals can make financial and healthcare decisions if you become unable to do so and that your wishes are followed after your passing.  Every adult benefits from having basic planning documents in place.

If you pass away without a will, New Jersey’s intestacy laws determine how your assets are distributed.  This may not reflect your personal wishes and can create unnecessary complications or disputes among family members.

Most estate plans include:

· A Last Will and Testament

· Durable Power of Attorney

· Advance Directive for Healthcare (Living Will)

Additional planning tools, such as trusts, may be appropriate depending on individual circumstances.

A will directs how assets are distributed after death and generally goes through probate.  A trust may allow assets to be managed or transferred outside of probate and can provide additional privacy and control in certain situations.

Not everyone needs a trust.  Trust planning depends on factors such as asset types, family circumstances, privacy concerns, and long-term planning goals.  An attorney can help determine whether a trust is appropriate for your situation.

Probate is the court-supervised process of administering a person’s estate.  In New Jersey, probate is often manageable, but proper planning can simplify or minimize the process depending on how assets are structured

You should review your estate plan after major life events, including:

· Marriage or divorce

· Birth or adoption of a child

· Significant financial changes

· Starting or selling a business

· Moving to a new state

Even without major changes, reviewing your plan every few years is advisable.

Yes.  Estate planning for business owners can address succession planning, ownership transfers, and continuity of operations, helping ensure stability for both family members and employees.
